武汉纺织大学研究生违纪处分条例

第一章  总  则

第一条  为了加强研究生教育管理,规范研究生在校期间的行为,促进研究生的健康发展,根据教育部《普通高等学校学生管理规定》的精神,结合我校实际,制定本条例。

第二条  本条例除了特别说明的条款以外,适用于各类在籍的研究生。

第二章  违纪与处分

第三条  对犯有错误的研究生,学校视其情节轻重,给予通报批评或纪律处分。处分有警告、严重警告、记过、留校察看、勒令退学、开除学籍六种。

第四条  留校察看以一年为限,受留校察看处分的研究生,一年内有显著进步表现的,可解除留校察看;经教育不改的给予勒令退学或开除学籍处分。

第五条  有反对四项基本原则的言论和行为、组织和煽动闹事、扰乱社会秩序、破坏安定团结、侮辱和诽谤他人行为者:

(一)情节严重,经教育尚能改正者,给予记过或留校察看处分;

(二)情节严重,经教育坚持不改者,给予勒令退学或开除学籍处分。

第六条 违反国家法律、法规,受国家权力机关处理者:

(一)被处治安警告或罚款者,根据情节,给予严重警告或记过处分;

(二)被处以行政拘留者,给予勒令退学处分;

(三)触犯国家刑法,构成刑事犯罪,被处刑罚者,给予开除学籍处分。

第七条 结伙斗殴或殴打他人、侵犯他人人身权利者:

(一)虽未动手打人,但挑起事端或偏袒一方,促使打架事态扩大者,给予警告或严重警告处分;

(二)动手打人,情节较轻者,给予警告或严重警告处分。情节严重或造成后果者,给予记过、留校察看、勒令退学直至开除学籍处分;

(三)对结伙斗殴的为首者,从重处分;对能主动承认错误并揭发他人者,从轻或减轻处分。

第八条  偷窃、诈骗(包括冒领、虚报)公私财物、盗用他人通信账号或破坏公共财物者,除追回赃款、赃物或赔偿损失外:

(一) 价值不满500元者,给予严重警告以下(含严重警告,下同)处分;

(二) 价值在500元以上1000元以内者,给予记过或留校察看处分;

(三) 价值1000元以上者,给予勒令退学或开除学籍处分;

(四) 通过网络盗用他人IP地址、用户帐号,危害网络安全者,给予警告或严重警告处分,情节严重者给予记过以上处分。

第九条  以现金或其他物品为赌注,进行赌博者:

(一)首次参与赌博,给予警告或严重警告处分;

(二)屡次参与赌博,给予记过或留校察看处分;情节严重者给予勒令退学或开除学籍处分。

第十条 有寻衅滋事、侮辱妇女、聚众斗殴等行为者,给予警告或严重警告处分;情节严重者,给予记过、留校察看或勒令退学处分。

第十一条  收看、复制、传播淫秽物品者:

(一) 凡在校园内观看淫书、淫画、淫秽录像片、带有黄色淫秽内容的相关软件等淫秽物品,经批评教育再犯者,给予警告或严重警告以上处分;

(二) 制作、复制、传播淫秽物品者,给予记过或留校察看以上处分;情节严重者,送交公安机关处理。

第十二条  持有毒品、吸毒、贩毒者,给予开除学籍处分。

第十三条  有下列行为者,给予记过处分;情节严重者,给予留校察看或勒令退学处分。

(一)在餐馆、饭厅、宿舍或其他公共场所酗酒、哄闹、砸酒瓶、烧杂物等扰乱公共秩序;

(二)扰乱课堂、校园、会场、影剧院等公共场所秩序;

(三)违反规定使用明火、私用电炉等电热器,或造成火灾,或破坏学校的电源线、广播线等公共设施;

(四)因成绩、论文评审、就业等原因,对教师或有关人员寻衅滋事,或诽谤、恐吓、报复等;

(五)拒绝、阻碍国家工作人员或学校管理人员依法或依校规执行公务;

(六)隐匿、毁弃或私拆他人邮件。

第十四条  有提供伪证、伪造证明、涂改或伪造证件等弄虚作假行为者,视情节轻重给予记过以下处分。

第十五条  在一学期内无故旷课累计(擅自离校者,旷课一天按4学时累计):

(一)达10学时者,给予警告处分;

(二)达20学时者,给予严重警告处分;

(三)达30学时者,给予记过处分;

(四)达40学时者,给予留校察看处分;

(五)达50学时者,给予勒令退学或开除学籍处分;

(六)对无故旷课未达10学时,但影响较坏,认错态度不好者,给予校、院通报批评,直至行政处分。

第十六条  在教室、图书馆、实验室等教学场所内不得将寻呼机、手机等无线通讯工具开至鸣叫状态。所佩戴寻呼机、手机等无线通讯工具在教学场所发出鸣叫者,按影响课堂秩序处理,经教育不改者,给予警告或严重警告处分。

第十七条  在考场有下列行为之一者,视为考试违纪,给予警告或严重警告处分。

(一)不按指定位置就坐,且不听从监考教师调动;

(二)不按规定将书包以及与考试有关的笔记、资料放在指定地点,且不听从监考教师劝告;

(三)监考教师要求出示研究生证明而拒绝出示;

(四)考试过程中未经监考教师同意而擅自进出考场;

(五)在考试过程中与别的考生谈话;

(六)将寻呼机、手机等无线通讯工具及文曲星等强存储功能的学习用品带入考场;

(七)未经监考人员允许将考卷携出考场。

第十八条  在考试过程中,有下列行为之一属考试作弊,视其情节给予记过或留校察看处分:

(一) 抄袭或偷看邻座答卷、稿纸(包括故意移动答卷让邻座偷看和抄袭);

(二) 传递与考试内容有关的纸条,或进行与考试内容有关的谈话或相互对答案;

(三) 闭卷考试中翻看书籍、笔记、资料或夹带与考试内容有关的东西;开卷考试中交换书、笔记本或有关考试的资料(包括交换的双方);

(四) 参与团伙作弊;

(五) 在考场内使用寻呼机、手机等无线通讯工具;

(六) 因保管不善等原因造成试卷、答题纸及草稿纸等物品在考试过程中或交卷时被他人利用,视为双方作弊。

(七) 其他考试作弊以监考老师报研究生处审核认定为准。

第十九条  有下列行为之一者属考试严重作弊,给予勒令退学处分:

(一)请人代考或代他人考试;

(二)涂改他人试卷姓名占为己有;

(三)组织团伙作弊。

第二十条  有下列违反学术道德行为之一者,视情节给予警告直至留校察看处分:

(一)发表学术论文时未经他人同意使用他人署名,或未经项目负责人同意标注资助基金项目,给予警告处分;造成不良影响者,给予严重警告或记过处分;

(二)发表学术论文一稿多投,给予警告处分;造成不良影响者,给予严重警告或记过处分;

(三)虚开或篡改发表文章接受函,给予严重警告处分;造成不良影响者,给予记过或留校察看处分。

第二十一条 有下列行为之一者,视情节给予严重警告直至勒令退学处分:

(一)在课题研究过程中伪造、篡改实验数据,给予严重警告处分;情节严重者,给予记过或留校察看处分。

(二)盗用他人研究数据(包括实验数据、调查数据、软件程序及其计算结果)等技术成果据为己有,给予留校察看处分;情节严重者,给予勒令退学处分。

(三)私自篡改课程成绩,给予记过处分;造成不良影响者,给予留校察看或勒令退学处分。

(四)盗用、贩卖或擅自传播本课题组技术专利、专有数据、保密资料、有偿使用软件等未公开的技术成果,给予留校察看处分;情节严重者,给予勒令退学处分。

(五) 制造或者恶意传播计算机病毒,给予留校察看处分;造成恶劣影响者,给予勒令退学处分。

(六)代他人写学术文章或学位论文,给予严重警告处分;造成不良影响者,给予记过或留校察看处分。

第二十二条  有下列行为之一者,视情节给予留校察看直至开除学籍处分:

(一)请他人代写或购买论文作为自己的学位论文或学术论文,给予勒令退学或开除学籍处分。

(二)在学位论文和发表的学术论文(包括期刊论文、会议论文等技术文章)中存在抄袭或剽窃者,给予留校察看处分;存在严重抄袭或剽窃者,给予勒令退学或开除学籍处分。

第二十三条  有下列情形之一,从重或加重处分:

(一)违纪后,认错态度不好者;

(二)对检举人、证人威胁或打击报复者;

(三)第二次因同样原因受违纪处分者。

第二十四条  受处分者,附加给予下列处罚:

(一)对享受奖学金者,自受到违纪处分的当月起,在一年内取消其奖学金资格;

(二)受严重警告以上(含严重警告)处分者不授予学位。

第二十五条  对于非学历教育研究生,在校的违纪行为由学校处理,在工作单位或属地的违纪行为由所在单位处理。

第三章  附  则

第二十六条  对犯错误的研究生,要热情帮助,严格要求。处理时要持慎重态度,坚持调查研究,实事求是,处分要适当。

第二十七条  处理结论同本人见面,允许本人申辩、申诉和保留不同意见。

第二十八条  研究生在处理结论见面后三天内,可向研究生处或有关部门提出书面申诉,有关部门在接到申诉后的七复审完毕。处分决定书下达后一般不得更改。

第二十九条  研究生违纪处分的具体处理部门为研究生处。警告和严重警告处分由学院讨论决定,报研究生处备案。记过以上(含记过)处分由研究生处报主管校长直至校长办公会审批,勒令退学或开除学籍报校长办公会审批。

第三十条  本条例从公布之日起施行,由研究生处负责解释。


Regulations of Wuhan Textile University on Disciplinary Actions for Graduate Students

Chapter I General Provisions

Article 1 For the purpose of strengthening graduate education management, regulating the conduct of graduate students during their time at Wuhan Textile University (WTU), and promoting their healthy development, the Regulations of Wuhan Textile University on Disciplinary Actions for Graduate Students (hereinafter referred to as the "Regulations") is hereby enacted in accordance with the Ministry of Education's Regulations on Student Management in Regular Higher Education Institutions and in light of the realities of WTU.

Article 2 Unless otherwise specified, the provisions hereunder shall apply to all enrolled graduate students of WTU.

Chapter II Violations and Disciplinary Actions

Article 3 For graduate students who commit violations, WTU shall impose either a public reprimand or disciplinary action based on the severity of the case. The types of disciplinary actions include warning, severe warning, demerit, probation, mandatory withdrawal, or expulsion.

Article 4 Probation is limited to one year. Graduate students who demonstrate significant improvement during the probation period may have their probation lifted. However, those who fail to reform after education shall be subject to mandatory withdrawal or expulsion.

Article 5 Graduate students who engage in actions or make statements against the Four Cardinal Principles, organize or incite disturbances, disrupt social order, damage social stability and unity, or insult and defame others shall be subject to disciplinary actions as follows:

(1) Students with serious violations and show willingness to reform after receiving education shall receive a demerit or probation;

(2) Students with serious violations and remain unrepentant after receiving education shall be subject to mandatory withdrawal or expulsion.

Article 6 Graduate students who are handled by state authorities for violations of national laws or regulations shall be disciplined as follows:

(1) Those who receive a warning or fine from the security administration authority shall be given a severe warning or demerit, depending on the severity of the case;

(2) Those who receive administrative detention shall be subject to mandatory withdrawal;

(3) Those convicted of a criminal offense and subject of criminal penalty under criminal law shall be expelled.

Article 7 Graduate students who participate in group fights, or physically assault others, or infringe on personal rights of others shall be disciplined as follows:

(1) Those who do not physically participate but escalate the situation by inciting or supporting one side shall receive a warning or severe warning;

(2) Those who physically assault others while the situation is minor shall receive a warning or severe warning. For severe cases or those resulting in consequences, the student shall receive a demerit, probation, mandatory withdrawal, or expulsion;

(3) The ringleaders of group fights shall receive a more severe punishment. Those who admit their wrongdoing and expose others involved shall be considered for lighter or reduced punishments.

Article 8 Graduate students who commit theft, fraudulently obtain (including falsely claiming or misreporting) public or private property, misuse others' communication accounts, or damage public property must return the stolen goods, repay funds, or compensate for damages. Additionally, the following provisions shall apply:

(1) If the value is less than CNY 500, the student shall receive a severe warning or lesser punishment;

(2) If the value is between CNY 500 and CNY 1,000, the student shall receive a demerit or probation;

(3) If the value exceeds CNY 1,000, the student shall be subject to mandatory withdrawal or expulsion;

(4) Those who compromise network security by misusing others' IP addresses or user accounts via the internet shall receive a warning or severe warning. Severe cases shall result in a demerit or harsher punishment.

Article 9 Graduate students who engage in gambling with cash or other valuables shall be disciplined as follows:

(1) First-time offenders shall receive a warning or severe warning;

(2) Repeat offenders shall receive a demerit or probation. Severe cases will result in mandatory withdrawal or expulsion.

Article 10 Graduate students involved in causing disturbances, insulting women, or participating in group fights shall be given a warning or severe warning. Severe cases will result in a demerit, probation, or mandatory withdrawal.

Article 11 Graduate students who view, duplicate, or distribute pornographic materials shall be disciplined as follows:

(1) Those who view pornographic books, images, videos, or software with obscene content on campus and repeat the offense after criticism and education shall receive a warning, severe warning, or harsher penalties;

(2) Those who produce, duplicate, or distribute pornographic materials shall receive a demerit or probation or harsher penalties. Severe cases will be referred to the public security authority.

Article 12 Graduate students found in possession of, using, or trafficking drugs shall be expelled.

Article 13 Graduate students who engage in the following actions shall receive a demerit. Severe cases will result in probation or mandatory withdrawal.

(1) Drunkenness, disruptive behavior, breaking bottles, burning items or other behaviors disrupting public order in public areas such as restaurants, dining halls, or dormitories;

(2) Disrupting order in classrooms, on campus, at events, in theaters or in other public areas;

(3) Improper use of open flames, unauthorized use of electric stoves or heaters, causing fires, or damaging public facilities like power lines or broadcasting systems of WTU against the rules;

(4) Harassing, defaming, intimidating, or retaliating against teachers or staff due to dissatisfaction with academic performance, thesis reviews, employment or other reasons;

(5) Refusing or obstructing the lawful duties of staff of government agencies or WTU;

(6) Hiding, destroying, or tampering with others' mails.

Article 14 Graduate students who provide false testimony, forge documents, or falsify or alter certificates shall be disciplined with a demerit or lesser punishment depending on the severity of the case.

Article 15 Graduate students with unjustified absences from class during any academic term shall be disciplined as follows (with each day of unauthorized absence from campus counted as 4 class hours):

(1) 10 class hours of absence shall result in a warning;

(2) 20 class hours of absence shall result in a severe warning;

(3) 30 class hours of absence shall result in a demerit;

(4) 40 hours of absence shall result in probation;

(5) 50 hours of absence shall result in mandatory withdrawal or expulsion;

(6) Students with absences of fewer than 10 hours but a poor attitude or negative influence shall receive penalties ranging from a public reprimand by the relevant faculty/school or WTU to administrative punishment.

Article 16 In classrooms, libraries, laboratories and other places of study, the pagers, mobile phones, or other wireless communication devices shall be kept in the non-disruptive mode. Students failing to do so shall receive a warning or severe warning for disrupting classroom order if they fail to reform after education.

Article 17 Students who engage in any of the following actions during examinations shall be considered to be in violation of exam regulations and receive a warning or severe warning:

(1) Failing to sit in assigned seats and ignoring instructions from invigilators;

(2) Failing to place bags or exam-related notes and materials in designated areas and disregarding the advice of invigilators;

(3) Refusing to present the graduate student ID upon request by invigilators;

(4) Entering or leaving the exam room without permission of the invigilator during the exam;

(5) Talking to other examinees during the exam;

(6) Bringing pagers, mobile phones, other wireless communication devices, as well as study tools with strong storage capabilities into the exam room;

(7) Removing the exam paper from the exam room without permission from invigilators;

Article 18 Any of the following acts during an examination shall be considered as cheating and warrant a demerit or probation, depending on the severity of the case:

(1) Copying or peeking at a neighboring student's exam paper or draft paper (including intentionally moving one's own paper for a neighboring student to see and copy);

(2) Passing notes related to the exam or engaging in conversations relevant to the exam, or discussing answers;

(3) Looking at books, notes, or materials, or bringing in items related to the exam in closed-book exams; exchanging books, notebooks, or materials related to the exam in open-book exams, in which case all parties involved shall be punished;

(4) Participating in organized collaborative cheating;

(5) Using pagers, mobile phones, or other wireless communication tools inside the exam room;

(6) Allowing others to use one's own exam paper, answer sheet, or draft paper during the exam or when submitting the paper due to negligence, which is considered cheating by both parties;

(7) Other forms of cheating, which shall be reported by the invigilator to the office of graduate affairs for review and decision making.

Article 19 Any of the following acts shall be considered as serious cheating during an exam, and will result in mandatory withdrawal:

(1) Hiring someone else to take the exam or taking an exam on behalf of someone else;

(2) Altering exam paper of someone else and claiming it as one's own;

(3) Organizing collaborative cheating.

Article 20 Any of the following acts shall be considered as a violation of academic integrity, and warrant punishment from warning to probation, depending on the severity of the case:

(1) Using name of someone else without their consent or listing a project's funding source without the principal investigator's consent in an academic paper to be published, which will result in a warning. If this causes negative effects, a severe warning or demerit shall be given;

(2) Submitting the same academic paper to multiple journals, which will result in a warning. If this causes negative effects, a severe warning or demerit shall be given;

(3) Falsifying or altering acceptance letters for academic articles, which will lead to a severe warning. If this causes negative effects, a demerit or probation shall be given.

Article 21 Any of the following acts shall lead to penalties ranging from a severe warning to mandatory withdrawal:

(1) Falsifying or altering experimental data during research, which will result in a severe warning, and even demerit or probation in severe cases;

(2) Stealing others' research data (including experimental data, survey data, software programs, and their calculation results) or other technical achievements and claiming them as one's own, which will result in probation, and even mandatory withdrawal in severe cases;

(3) Altering course grades without authorization, which will result in a demerit, and even probation or mandatory withdrawal if this causes negative effects;

(4) Stealing, selling, or unauthorized dissemination of technical patents, proprietary data, confidential materials, or fee-based software from the research group, which will result in probation, and even mandatory withdrawal in severe cases;

(5) Creating or maliciously spreading computer viruses, which will result in probation, and even mandatory withdrawal if this causes baneful effects;

(6) Writing academic papers or dissertations on behalf of others, which will result in a severe warning, and even a demerit or probation if this causes negative effects.

Article 22 Any of the following acts shall warrant penalties ranging from probation or expulsion from WTU:

(1) Hiring someone else to write or purchasing a dissertation or academic paper to submit as one's own, which will result in mandatory withdrawal or expulsion;

(2) Plagiarizing or copying in dissertations or published academic papers (including journal articles, conference papers, etc.), which will result in probation, and even mandatory withdrawal or expulsion in severe cases.

Article 23 Any of the following actions shall result in stricter or harsher penalties:

(1) Poor attitude or lack of remorse after committing a violation;

(2) Threatening or retaliating against informants or witnesses;

(3) Receiving disciplinary action for the same violation more than once.

Article 24 Additional penalties shall be imposed to graduate students disciplined as follows:

(1) Disciplined students who are scholarship recipients shall be deprived of their eligibility for scholarship for one year from the month of the disciplinary action;

(2) Students receiving a severe warning or harsher penalties shall not receive any degree.

Article 25 For non-degree graduate students, violations on campus shall be handled by WTU, and violations at work or in their locality shall be handled by their employers or local authorities.

Chapter III Supplementary Provisions

Article 26 Graduate students who make mistakes shall be provided with help and strict guidance. Disciplinary actions must be handled cautiously, based on the facts and thorough investigation and research, and the penalties must be appropriate.

Article 27 The student shall be informed of the conclusion of the disciplinary process, allowing the student to make a defense or appeal, and express a dissenting opinion.

Article 28 Graduate students may submit a written appeal to the office of graduate affairs or relevant departments within three days after receiving the conclusion of the disciplinary process. The appeal shall be reviewed within seven days. Once the disciplinary outcome letter is issued, no changes shall be made in general.

Article 29 The office of graduate affairs shall be responsible for handling disciplinary actions against graduate students. Warnings and severe warnings shall be discussed and decided by the relevant faculty/school and then reported to the office of graduate affairs for the record. Demerit and harsher penalties shall be reported by the office of graduate affairs to the president in charge and be approved by at the president’s meeting. Expulsion or mandatory withdrawal must be approved by the at the president’s meeting.

Article 30 This Regulations shall come into effect from the date of promulgation and be interpreted by the office of graduate affairs.
